K-Connect Terms of Service

These Terms of Service constitute a binding legal instrument governing access to and use of K-Connect, the official authentication and identity management service of the Principality of Kaharagia.

Definitions and Interpretation

In these Terms of Service, unless the context otherwise requires:

  • "K-Connect" means the official authentication, identity verification, and single sign-on service of the Principality of Kaharagia, including all associated systems, protocols, and interfaces.
  • "Kaharagia" or "the State" means the Principality of Kaharagia, its sovereign institutions, and competent authorities acting under lawful mandate.
  • "User" means any natural or legal person who accesses, registers for, or uses K-Connect.
  • "Credentials" means any password, passphrase, authentication token, cryptographic key, biometric factor, or other means of verifying identity used in connection with K-Connect.
  • "Connected Services" means the Kaharagian ePortal and any other digital services of the Principality of Kaharagia that utilise K-Connect for authentication.
  • "Terms" means these Terms of Service, as amended from time to time.

References to statutory provisions include any subordinate legislation made thereunder and any subsequent amendments or re-enactments.

Identity and Purpose of the Service

K-Connect is the official authentication, identity verification, and access management service of the Principality of Kaharagia, established and operated under sovereign authority. K-Connect provides a unified and secure mechanism for:

  • User authentication and identity verification
  • Credential issuance, management, and revocation
  • Session establishment, maintenance, and termination
  • Federated identity services across authorised Kaharagian digital platforms
  • Access control and authorisation for Connected Services

K-Connect exists solely as identity and authentication infrastructure. It is expressly not a substantive governmental, administrative, or civic service. K-Connect does not:

  • Make administrative decisions or determinations affecting legal rights or status
  • Process applications, petitions, or submissions of any kind
  • Issue certificates, permits, licences, or official documents
  • Confer any legal status, entitlement, or privilege
  • Produce any legally binding outcome beyond verification of identity

Relationship to Connected Services

K-Connect enables authenticated access to the Kaharagian ePortal and other authorised digital services of the Principality of Kaharagia.

Successful authentication through K-Connect:

  • Does not guarantee access to any particular Connected Service, which may impose additional eligibility requirements;
  • Does not imply authorisation, approval, endorsement, or favourable treatment by any Connected Service;
  • Does not confer any legal status, right, privilege, or entitlement;
  • Does not validate, certify, or guarantee the accuracy or legal effect of any data, submission, or outcome in any Connected Service;
  • Does not establish any relationship with Connected Services beyond authenticated access.

Each Connected Service is governed by its own Terms of Service, Privacy Notice, and applicable legal framework. Users are responsible for reviewing and accepting the terms of each Connected Service they access.

Acceptance of Terms and Legal Effect

By accessing, registering for, or otherwise using K-Connect, you irrevocably confirm and warrant that you:

  • Have read, understood, and accept these Terms in their entirety and without reservation;
  • Possess the legal capacity to enter into binding obligations under applicable law;
  • Agree to be bound by these Terms under Kaharagian law; and
  • Accept that these Terms constitute a binding legal instrument enforceable against you.

If you do not agree to these Terms, or if you lack the capacity to accept them, you must immediately cease all access to and use of K-Connect.

Use of K-Connect establishes a limited public-law legal relationship between the User and the Kaharagian State, the scope of which is confined to authentication and identity verification. No broader administrative, contractual, or service relationship is created by the mere use of K-Connect.

Governing Law, Sovereignty, and Jurisdiction

Applicable Law

These Terms, K-Connect, and all matters arising from or relating to their interpretation, application, or use are governed exclusively and in all respects by the laws of the Principality of Kaharagia, including sovereign decrees, regulations, administrative acts, and binding instruments duly promulgated in the Royal Kaharagian Gazette.

No foreign law, legal principle, or regulatory framework applies to these Terms or K-Connect unless expressly and formally incorporated into Kaharagian law by competent sovereign authority.

Technical Hosting and Foreign Legal Assertions

K-Connect may be hosted on technical infrastructure located outside Kaharagian territory, including within the Federal Republic of Germany or other jurisdictions, and may utilise domain registrars, certificate authorities, or service providers situated in foreign jurisdictions.

These technical and administrative arrangements:

  • Do not constitute consent, submission, or subjection to any foreign jurisdiction;
  • Do not create, confer, or imply any enforceable rights, claims, or causes of action under foreign law;
  • Do not alter, diminish, or qualify the sovereign legal order of Kaharagia or its exclusive jurisdiction over K-Connect.

Any purported extraterritorial legal obligation—including foreign data protection requirements, identity regulation, or cybersecurity mandates—shall be recognised only if and to the extent formally adopted within Kaharagian law.

Eligibility and Access Control

Eligible Users

Access to K-Connect is not a matter of general right but is subject to authorisation by law, regulation, or competent authority. Eligible Users may include, without limitation:

  • Nationals of the Principality of Kaharagia
  • Residents, applicants for residence, or persons seeking legal status
  • Officials, officers, and institutional appointees of Kaharagian institutions
  • Mandated contractors, agents, and authorised service providers
  • Other persons or entities expressly authorised by competent authority

No general, implied, or derivative right of access exists. Credentials may be issued, suspended, or revoked at any time by competent authority without prior notice and without obligation to provide reasons, subject only to applicable law.

Credential Responsibilities and Security Obligations

Users bear sole and exclusive responsibility for:

  • Safeguarding all Credentials, authentication factors, and access devices against loss, theft, disclosure, or compromise;
  • Establishing and maintaining strong, unique passwords or passphrases that are not used for any other service;
  • Preventing any unauthorised access to or use of their K-Connect account or Credentials;
  • Immediately reporting to the competent authority any suspected or actual loss, theft, compromise, or unauthorised use of Credentials;
  • Complying with all security guidance, policies, and requirements issued by the State.

Users shall not share, transfer, lend, or disclose Credentials to any third party for any purpose, except as expressly authorised by law or competent authority.

All authentication events and actions undertaken using a User's Credentials are irrebuttably presumed to have been initiated and authorised by that User unless the User has previously reported the compromise of their Credentials in accordance with established procedures.

Permitted Use and Prohibited Conduct

Scope of Permitted Use

K-Connect may be used solely and exclusively for lawful authentication and access to authorised Connected Services of the Principality of Kaharagia.

Prohibited Conduct

Users shall not, whether directly, indirectly, or through any agent, device, or automated means:

  • Attempt to bypass, circumvent, disable, or weaken any authentication control, security mechanism, or access restriction;
  • Share, disclose, transfer, or otherwise make available Credentials to any unauthorised person;
  • Use automated tools, scripts, bots, or other means to interact with K-Connect authentication endpoints without authorisation;
  • Attempt to harvest, collect, or obtain Credentials, identity information, or authentication tokens belonging to other users;
  • Impersonate any person, misrepresent identity, or create accounts using false or fraudulent information;
  • Interfere with, disrupt, or compromise the integrity, availability, or security of K-Connect or any Connected Service;
  • Probe, scan, or test the vulnerability of K-Connect systems or attempt to gain unauthorised access to any system, network, or data;
  • Use K-Connect for purposes of surveillance, profiling, tracking, or exploitation of any person;
  • Engage in any conduct that violates Kaharagian law or these Terms.

Violation of these prohibitions may result in immediate suspension or revocation of Credentials, referral for investigation, and prosecution under applicable Kaharagian law, including criminal sanctions where warranted.

Security Measures and Residual Risk

Security by Design

Kaharagia implements and maintains reasonable, proportionate, and state-of-the-art technical and organisational security measures designed to protect K-Connect and User identity data against unauthorised access, disclosure, alteration, or destruction. Such measures may include, without limitation:

  • Strong cryptographic protocols for authentication and session management
  • Secure storage of Credentials using industry-standard hashing and encryption
  • Multi-factor authentication capabilities where available
  • Session controls, timeouts, and automatic expiry mechanisms
  • Continuous monitoring, logging, and anomaly detection systems
  • Administrative, procedural, and physical security safeguards
  • Regular security assessments, penetration testing, and vulnerability management

Security is treated as a critical public-trust function and a matter of paramount importance.

Disclaimer of Absolute Security

Notwithstanding the foregoing, no authentication system, network, or digital service can be guaranteed to be absolutely secure against all threats, attacks, or vulnerabilities. Kaharagia expressly disclaims any warranty or representation that:

  • K-Connect is immune from cyberattack, intrusion, compromise, or failure;
  • Credential theft, phishing, social engineering, or third-party interference can be prevented in all circumstances;
  • K-Connect will operate without interruption, error, or degradation.

Users expressly acknowledge and accept that residual risk is inherent in all digital identity and authentication systems and that use of K-Connect is undertaken with full awareness of such risk.

Data Processing and Privacy

K-Connect processes only the minimum personal data strictly necessary to provide authentication and identity verification services, in accordance with Kaharagian data protection law, sovereign decrees, and institutional rules governing identity management.

The K-Connect Privacy Notice, which forms an integral and binding part of these Terms, sets forth the categories of data processed, purposes of processing, retention periods, data subject rights, and related matters.

Where appropriate and without prejudice to sovereign jurisdiction, Kaharagia may voluntarily align its data protection practices with internationally recognised principles, including concepts derived from the General Data Protection Regulation (GDPR), to the extent consistent with Kaharagian law. Such alignment does not constitute acceptance of foreign jurisdiction, recognition of foreign law, or waiver of sovereign immunity.

Rights relating to identity data exist only to the extent expressly provided under Kaharagian law and may be limited or excluded for reasons of security, system integrity, fraud prevention, or public administration.

Disclaimer of Warranties

K-Connect is provided strictly on an "as is" and "as available" basis, without warranty of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by Kaharagian law, Kaharagia expressly disclaims all warranties, representations, and conditions, including but not limited to:

  • Warranties of availability, uptime, reliability, or continuity of service;
  • Warranties of compatibility with any device, platform, browser, or operating system;
  • Warranties of error-free, uninterrupted, or secure authentication;
  • Warranties of continuous or unimpeded access to any Connected Service.

Temporary or permanent unavailability of K-Connect does not constitute fault, breach, or administrative error on the part of the State.

Limitation of Liability

To the fullest extent permitted by Kaharagian law:

  • The Kaharagian State, its institutions, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to K-Connect;
  • No liability shall arise from authentication failure, denial of access, or inability to access any Connected Service;
  • No liability shall arise from Credential compromise, theft, or misuse beyond the reasonable control of the State;
  • No liability shall arise from User reliance upon successful authentication as evidence of authorisation, entitlement, or approval in any Connected Service.

Authentication through K-Connect does not create liability for any outcome, determination, or consequence in any Connected Service.

Nothing in these Terms shall be construed to exclude or limit liability where such exclusion or limitation is expressly prohibited by sovereign law.

Suspension, Revocation, and Termination

Credentials and access to K-Connect may be suspended, revoked, or terminated, in whole or in part, temporarily or permanently, at any time and without prior notice:

  • For breach or suspected breach of these Terms or applicable law;
  • For security, integrity, or operational reasons;
  • Upon request of the User;
  • By administrative decision, sovereign decree, or judicial order;
  • Where access is no longer legally justified or authorised.

No compensation, damages, or indemnity shall be payable in respect of any suspension, revocation, or termination of Credentials or access.

Termination of access does not release the User from any obligations, liabilities, or consequences accrued prior to or arising from the termination.

Institutional Authority and Non-Waiver

Nothing in these Terms shall be construed to:

  • Limit, constrain, or fetter the sovereign authority of the Principality of Kaharagia;
  • Restrict the lawful exercise of administrative discretion by competent authorities;
  • Waive, release, or prejudice any enforcement power, remedy, or right of action available to the State;
  • Create any estoppel, legitimate expectation, or actionable reliance against the State.

The failure or delay by the State to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision, nor shall it prejudice the right of the State to enforce such provision at any time thereafter.

Official Communications and Correspondence

External and Cross-Border Legal Matters

All enquiries, correspondence, and legal communications relating to external legal matters, including but not limited to foreign legal claims, intellectual property assertions, service of foreign legal process, extraterritorial regulatory notices, and international legal correspondence, shall be directed exclusively to:

The Office of Legal Affairs is the sole competent authority for engagement with non-Kaharagian legal systems, foreign courts, and international legal processes.

Internal Law, Enforcement, and Administrative Matters

All enquiries, correspondence, and legal communications relating to Kaharagian law, including interpretation, application, enforcement, compliance, administrative decisions, credential disputes, and internal legal proceedings, shall be directed exclusively to:

Effect of Correspondence

The submission of correspondence to any Kaharagian authority:

  • Does not create any obligation to respond, acknowledge, or act upon the correspondence;
  • Does not suspend, toll, or extend any deadline, limitation period, or enforcement action;
  • Does not constitute the provision of legal advice, official guidance, or professional opinion;
  • Does not replace, satisfy, or substitute for formal legal procedures, applications, or filings.

Only communications formally issued through official channels and bearing appropriate authentication shall have legal effect.

Amendment and Revision

These Terms may be amended, revised, supplemented, or replaced at any time by the State without prior notice to Users. The current version of these Terms shall be published and shall supersede all prior versions.

Continued access to or use of K-Connect following the publication of amended Terms constitutes acceptance of and agreement to be bound by the amended Terms.

Severability

If any provision of these Terms is held to be invalid, unlawful, void, or unenforceable by a court or tribunal of competent jurisdiction under Kaharagian law, such provision shall be severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with the K-Connect Privacy Notice and any other documents expressly incorporated by reference, constitute the complete and exclusive legal framework governing access to and use of K-Connect, subject only to superior legal instruments duly promulgated under Kaharagian law.
